How to Recover Damages in a Car Accident with an Uninsured Driver?

Following a car accident, drivers must exchange insurance information with all other parties involved in the crash. If you find out that the at-fault driver does not have auto insurance, you may be able to recover damages through: 

  • Your uninsured motorist (UM) coverage. UM is optional insurance coverage that provides additional protection in the event of hit-and-run crashes and accidents involving uninsured drivers.  
  • Med pay and health insurance. You may be able to use your medical payments coverage (med pay) and health insurance to cover some of your medical expenses resulting from an accident with an insured motorist.

What Happens if I Don’t Have Uninsured Motorist (UM) Coverage?

  1. Provide an accident report to your insurance company; and
  2. Demonstrate evidence of physical contact between your car and the vehicle of the uninsured motorist. 

The second element may not be necessary if you have witnesses who can verify how your accident occurred. Uninsured motorist coverage can also be used if you were hit by a driver who fled the scene of the crash.
